Article 1: Preamble
ETRIER.EU is a brand belonging to a French simplified joint-stock company (SAS) REFLEX. These general terms and conditions of sale represent all the stipulations constituting the offer made by REFLEX, a simplified joint-stock company with a share capital of €100,000, having its registered office at BAILLEUL (59270), registered with the Dunkirk Trade and Companies Register under number 522 043 348, intra-community VAT number FR66 522 043 348, hereinafter referred to as "REFLEX" or "we", to any potential purchaser of its products via the website www.etrier.eu (new window), hereinafter referred to as "the user" or "the customer".
Placing an order implies the customer's full and unconditional acceptance of these general terms and conditions of sale. Any contrary condition imposed by the customer is unenforceable against REFLEX. REFLEX cannot be contractually bound by any document other than these general terms and conditions of sale, and in particular by brochures or catalogues, which are provided for information purposes only. REFLEX hereby reserves the right to modify these general terms and conditions of sale at any time.
Any customer may consult the general terms and conditions of sale at any time on the website www.etrier.eu (new window) (hereinafter "the site"). As these general terms and conditions of sale may be subject to modifications, the applicable conditions are those in effect on the website at the date your order is placed.
Any reproduction, in whole or in part, is systematically subject to authorisation by REFLEX.
The purpose of these general terms and conditions of sale is to define the terms of sale between REFLEX and the user, from order placement to after-sales services, including payment and delivery. They govern all the steps necessary for placing an order and ensure its follow-up between the contracting parties.
Article 2: Acceptance of Terms
The customer acknowledges having read, at the time of placing the order, the general terms and conditions of sale set forth in this document and formally declares to accept them without reservation.
Article 3: Products
The characteristics of the products ordered by the customer are indicated on the pages of the site. All products offered comply with French legislation in force and the standards applicable in France.
Certain products are guaranteed by the supplier against manufacturing defects, but not against normal wear and tear resulting from regular use or misuse of the product.
Photographs illustrating the products are provided for illustrative purposes only.
Our products are offered subject to available stock.
Products remain the property of REFLEX until full payment of the price.
REFLEX's liability cannot be engaged in the event of non-compliance with the legislation of the country to which the product is delivered.
Products are described and presented as accurately as possible. However, if minor errors or omissions have occurred in this presentation, REFLEX's liability cannot be engaged.
Article 4: Prices
Prices are indicated in euros inclusive of all taxes. They take into account the value added tax applicable on the day of the order, excluding processing and shipping costs.
We reserve the right to modify these prices at any time, but products will be invoiced on the prices in effect at the time the order is recorded.
Article 5: Orders
Orders are placed on the site and can only be recorded on it if the user has clearly identified themselves by entering their email address (or the specific identifier for the etrier.eu site) and their password, which are strictly personal to them.
Contractual information is presented in French and will be confirmed at the latest at the time of delivery. We reserve the right to cancel or refuse any order from a customer with whom a dispute exists relating to payment of a previous order.
Any order constitutes acceptance of the prices, these general terms and conditions of sale and the description of the products available for sale. Any dispute on this point will be handled within the framework of an exchange, return or the guarantees mentioned below.
In the case of an order by a professional, REFLEX shall incur no liability for any indirect damages arising hereunder, including loss of business, loss of profit, loss of opportunity, damages or costs that may arise from purchasing the products.
Article 6: Validation
In accordance with the provisions of Articles 1366 et seq. of the Civil Code relating to the law of evidence and electronic signatures, the online entry of the bank card number and the final validation of the order constitute irrevocable acceptance of the general terms and conditions of sale and payment.
They also constitute proof of all transactions carried out by REFLEX and its customer and serve as proof of the entirety of the said order and of the due and payable status of the amounts incurred by entering the items appearing on the order form. This validation constitutes express acceptance of all operations carried out on the site.
Any order will be confirmed by REFLEX by an email sent to the customer upon validation of their order or at the latest at the time of dispatch.
In the event of fraudulent use of their bank card, the customer is requested, upon becoming aware of such use, to contact our customer service.
Article 7: Availability
Our product offers are made subject to available stock. In the event of a product being unavailable after your order has been validated, we will inform you by email as soon as possible.
Your order will then be automatically cancelled. In accordance with the provisions of Article L. 216-3 of the Consumer Code, REFLEX undertakes to refund all sums paid within fourteen (14) days from the date of cancellation of the order.
The refund will be made using the same means of payment used for the initial transaction, unless the customer expressly agrees to another method of reimbursement that does not incur additional costs for them.
Article 8: Delivery
8.1 Delivery Times: Products are delivered to the address indicated by the customer. The delivery times displayed on the site correspond to average processing and dispatch times, to which the carrier's transit time is added. Although these timeframes are given for indicative purposes, REFLEX undertakes, in any event, to deliver the products within a maximum period of thirty (30) days after the order has been validated. Delivery is carried out by the carrier selected at the time of ordering, according to the opening days and hours specific to each service provider. The customer is informed of the tracking of their parcel and the carrier's delivery arrangements via the contact details (email or SMS) provided at the time of ordering.
8.2 Delayed Delivery: In the event of this 30-day period being exceeded, the customer may cancel the contract by registered letter with acknowledgement of receipt or in writing on another durable medium, if, after having given formal notice to REFLEX to make the delivery within a reasonable additional period, the latter has not done so.
8.3 Transfer of risk and receipt: Upon delivery, the customer shall check the condition of the packaging and the conformity of the product. If the parcel is visibly damaged, the customer is invited to refuse it or to make precise reservations on the carrier's delivery note. Without prejudice to the customer's statutory rights, in the event of a defective product, we invite them to report any anomaly to REFLEX's customer service as soon as possible. This enables us to pursue our rights of action against the carrier within the legal timeframes (in particular that of Article L133-3 of the Commercial Code which binds us, REFLEX, to the carrier).
8.4 Liability: REFLEX is fully liable to the customer for the proper performance of the obligations arising from the distance contract. However, REFLEX may be released from all or part of its liability upon bringing proof that the non-performance or improper performance of the contract is attributable either to the customer (e.g. address entry error), to the unforeseeable and insurmountable act of a third party to the contract, or to a case of force majeure as defined by French jurisprudence (in particular in the event of a total or partial strike by postal or transport services, exceptional bad weather or natural disasters). Finally, REFLEX shall not be held liable for any inconvenience or damage inherent in the use of the Internet network, notably a service interruption, an external intrusion, or the presence of computer viruses.
8.5 Delivery disputes and Non-receipt: Relay Point: In the event of impossibility of delivery to the chosen relay point (closure, saturation), the carrier may deliver the parcel to the nearest available relay point. The customer will be informed of this and may not hold REFLEX responsible for this change beyond its control. Delivery investigation: If the customer disputes the delivery while the carrier confirms it, REFLEX will open an internal investigation. To allow this investigation, the customer must send the customer service, within 15 working days, a complete file comprising:
- A signed affidavit of non-receipt.
- A copy of a valid ID document.
- Where applicable, a police report or any relevant supporting document.
Re-dispatch: In the event of re-dispatch of the product following a first delivery declared as not received, REFLEX may ask the customer to formally commit to refusing or returning at their own expense the first parcel if it were to be delivered late. Failing the return of the surplus product within 10 days of its receipt, REFLEX reserves the right to charge for this second product. Upon completion of the investigation, if the failure to deliver is confirmed, REFLEX shall refund or re-dispatch in accordance with the terms of Article L 216-2 of the Consumer Code.
Article 9: Payment and Security
9.1 Means of payment: Purchases are paid for online by bank card (Visa, MasterCard, Carte Bleue, Bancontact) or via a PayPal account.
9.2 Security: Transactions are secured by the Worldline payment platform (formerly Ingenico/Ogone). Banking data is encrypted via the TLS (Transport Layer Security) protocol and is never transmitted in unencrypted form over the network. Approval from the interbank network (GIE Carte Bancaire) triggers the acceptance of the order. Your account is debited for the total amount of the order upon its confirmation on the website.
9.3 Fraud prevention: REFLEX uses automated order data processing tools to prevent bank card fraud.
9.4 Payment incidents: In the event of a fraud alert or payment incident, REFLEX reserves the right to suspend the order for verification or to cancel it. The customer may be asked to provide additional supporting documents or to use another means of payment. Information relating to your order is subject to automated data processing. The purpose of this processing is to define a level of transaction analysis and to combat bank card fraud.
9.5 Data protection: In accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act of January 6, 1978, as amended, the customer has, at any time, the right of access, rectification, deletion and objection to all their personal data by writing to service-client@etrier.eu or by post to the REFLEX address indicated at the end of this document, providing proof of their identity.
Article 10: Shipping Costs
Shipping costs are calculated based on the delivery location and the nature of the products ordered (items at regular price or on promotion/sale).
10.1 Delivery in Metropolitan France (including Corsica):
- Regular-priced items: Mondial Relay relay point shipping is free for any order of €39 or more (including VAT).
- Items on promotion, sale or guaranteed low prices: Free Mondial Relay relay point delivery applies for any order of €59 or more (including VAT).
10.2 Delivery to Belgium and the rest of Europe:
- Regular-priced items: Shipping is free for any order of €99 incl. VAT or more.
- Items on promotion, sale or guaranteed low prices: Free delivery applies for any order of €150 or more (including VAT).

10.3 Common provisions: For any order below these free delivery thresholds, a contribution to preparation and shipping costs is charged in addition. The amount of this contribution is indicated to the customer before the final validation of their order. REFLEX reserves the right to modify these amounts and conditions at any time, in particular in accordance with updates to carrier rates.
Article 11: Right of Withdrawal and Returns
11.1 Withdrawal period: The customer has a period of 30 calendar days from receipt of the product to exercise their right of withdrawal, without having to provide any justification.
11.2 Return procedure: To exercise this right, the customer must go to the site under the "My Account" section, then to their "Order History". They must select the relevant order, click on "Return Request", choose the item(s) to be returned, select a reason and confirm the request. The customer may also make this request via the customer service by email. The return slip will be sent by email and will remain accessible in the customer account area.
11.3 Return costs:
- In Metropolitan France: Returns shall be free of charge if the customer uses exclusively the Mondial Relay procedure via the return slip provided by REFLEX. Printing costs for the return slip remain the customer's responsibility.
- Outside Metropolitan France: Return costs are the exclusive responsibility of the customer. The product must be returned to the address of REFLEX's registered office.
11.4 Refund terms: REFLEX refunds all sums paid within fourteen (14) days following the date on which it is informed of the customer's decision to withdraw. However, in accordance with Article L221-24 of the Consumer Code, this refund will be deferred until the actual receipt of the products by REFLEX or until the customer provides proof of dispatch of the goods, the date retained being that of the first of these events.
11.5 Condition of the product: The product must be returned in its original condition, complete (packaging, accessories, instructions...) and accompanied by its invoice. Any product that is incomplete, damaged, or soiled cannot be refunded or exchanged.
Article 12: In-Store Exchange
The customer has the option of exchanging their product in ETRIER official stores within thirty (30) calendar days from the date of receipt of their order.
In order to be eligible for exchange, the product must be returned in its original condition, complete (packaging, accessories, instructions...) and must be accompanied by the original purchase invoice.
Any product that is incomplete, damaged, or soiled cannot be exchanged. In-store exchanges are subject to stock availability. If an exchange is not possible, the customer may benefit from the remedies set forth in Article 11.
Article 13: Returns – Refunds (Legal Guarantees)
13.1 Non-conformity and Defects: In addition to the return procedure set out in Article 11, if the product does not correspond to the customer's order or has defects, it must be returned within the timeframes applicable to the legal guarantee of conformity and the legal guarantee against latent defects from the date of receipt.
13.2 Return address and conditions: The product must be returned to the following address: REFLEX - Parc d'activités de la Verte rue - 432 Allée des Prêles, Bailleul (59270) - France. It must be returned in its original condition and complete (packaging, accessories, instructions...) and accompanied by a copy of the invoice. Warning: Incomplete, damaged, or soiled products will not be accepted for return. (Note: For defective products under warranty, this clause applies to damage caused by the customer that is not related to the original defect.)
13.3 Refund: REFLEX refunds all sums paid by the customer via the means of payment used at the time of purchase, where the legal guarantee of conformity applies or if the product can neither be repaired nor replaced. The customer must place a new order if they wish to receive the product corresponding to their original order.
13.4 Free procedure (France): For a period of 30 days from the date of dispatch of the product, the customer may return it free of charge by dropping off their parcel exclusively at a Mondial Relay relay point. The customer must:
- Go to their Order History.
- Select the order and click on "Return Request".
- Select the items, the reason and confirm.
- Print the return slip received and affix it to the parcel.
Printing costs for the return slip are not covered by REFLEX. Upon receipt, the parcel is processed within 5 working days. In accordance with the operation of the site, the customer may make several return requests per order if the order contains several products.
Article 14: Personal Data Protection (GDPR)
14.1 Collection and Purposes: REFLEX hereby undertakes to protect the privacy of site users. The personal data collected are necessary for order management, delivery, and invoicing. It may also be used to personalise communication (newsletters, information emails) and improve the customer experience on the site.
14.2 Confidentiality and Sharing: The data collected is for internal use and is never disclosed to third parties for commercial purposes. However, it may be transmitted to our service providers (e.g. carriers for delivery, payment service providers, technical services of the group to which REFLEX belongs) strictly within the limits of contract performance.
14.3 Users' rights: In accordance with the GDPR (Regulation 2016/679) and the Data Protection Act, the customer has the following rights over their data:
- Right of access and rectification: to update their information.
- Right to erasure (right to be forgotten): to request the deletion of their account.
- Right to object: in particular to no longer receive commercial prospecting.
- Right to portability: to retrieve their data in a structured format.
14.4 Exercising rights: These rights may be exercised at any time by sending an email to dpo@etrier.eu or by post to the REFLEX address indicated at the end of this document, providing proof of identity.
14.5 Retention: Data shall be retained for the period necessary for managing the commercial relationship and legal obligations (accounting, guarantees).
Article 15: Intellectual Property
15.1 Legal protection: All content of the website (texts, comments, product descriptions, illustrations, photographs and images) are protected under copyright law, trademark law, patent law and image rights. They shall remain the sole and exclusive property of REFLEX SAS.
15.2 Authorised use: As such and in accordance with the provisions of the Intellectual Property Code, only use for private and non-commercial purposes shall be authorised, subject to different or more restrictive provisions of the Intellectual Property Code.
15.3 Sanctions: Any total or partial reproduction, representation, modification or adaptation of the elements of the site (in particular the product catalogue) is strictly prohibited and constitutes an act of infringement punishable under the Intellectual Property Code, unless prior written authorisation is obtained from REFLEX.
Article 16: Applicable Law and Disputes
16.1 Liability: REFLEX's liability shall not be incurred for any inconvenience or damage inherent in the use of the Internet network, notably a service interruption, an external intrusion or the presence of computer viruses. Similarly, REFLEX cannot be held liable for any indirect damage, loss of business or profit arising in any way whatsoever in connection with use of the site or an order.
16.2 Applicable law: These General Terms and Conditions of Sale are governed by French law. In the event of a dispute, the parties shall first attempt to resolve the dispute amicably.
16.3 Competent court: Failing an amicable settlement or mediation, the French courts shall have sole jurisdiction to settle the dispute.
Article 17: Legal Guarantees
All products supplied by REFLEX shall be covered by the legal guarantee of conformity (Articles L. 217-3 et seq. of the Consumer Code) and the guarantee against latent defects (Articles 1641 to 1649 of the Civil Code).
17.1 Legal guarantee of conformity: When acting under the legal guarantee of conformity, the customer:
- Has a period of two (2) years from delivery of the goods to file a claim;
- May choose between repair or replacement of the goods, subject to the cost conditions provided for in Article L. 217-12 of the Consumer Code;
- Is not required to prove the existence of the non-conformity of the goods during the 24 months following delivery of the goods.
17.2 Guarantee against hidden defects: The customer may decide to invoke the guarantee against hidden defects of the item sold within the meaning of Article 1641 of the Civil Code. In this case, they may choose between rescission of the sale (full refund) or a reduction in the sale price in accordance with Article 1644 of the Civil Code.
Article 18: Amendment of the GTC – Contact and Complaints
18.1 Amendment of the GTC: REFLEX reserves the right to modify these general terms and conditions of sale at any time. The applicable conditions are those in effect on the date of the customer's order.
